DEFENDING A CLAIM FOR REINSTATEMENT AT THE INDUSTRIAL COURT Many human resource or industrial relations practitioners understand that both employers and employees have rights which are protected by the Industrial Court, particularly in relation to termination of employment. However, they worry that even when their organization has followed a correct and fair procedure prior to a dismissal, the Court may find otherwise and their good reputation as an efficient and knowledgeable human resource officer will be damaged. In this article, a number of suggestions will be made which may assist in increasing the likelihood that a dismissal will be upheld by the Industrial Court. |
